Purpose

To describe how Pilates International Training Centre (Pilates ITC) manages copyright material to ensure compliance with relevant legislation and licensing obligations.

We’re committed to using and sharing learning materials in a responsible, lawful, and respectful way—for the benefit of our students, staff, and wider community.


Definitions

  • Training Organisation: Refers to Pilates International Training Centre (Pilates ITC).

  • Copyright Act: Refers to the Copyright Act 1968 (Cth), including relevant amendments.

  • Statutory Licence: A legislative framework that allows copying and communicating copyrighted material under set conditions.


Who This Policy Applies To

This policy applies to all students, staff, and contractors engaged in activities with Pilates ITC.


Our Policy

1. Legislative Requirements and Copyright Licensing

Pilates ITC complies with the Copyright Act 1968 and any relevant licence agreements that support educational use of copyright-protected materials.

1.1 Statutory Licence Usage

  • Any digital copying or sharing of third-party copyrighted content under the Statutory Licence (Division 4 of Part IVA of the Act) must occur only via the central approved repository maintained by Pilates ITC.

  • Additional repositories may be authorised by the CEO if needed.

1.2 Licensed Databases

  • Pilates ITC may hold commercial licence agreements with publishers or vendors for access to journals, eBooks, and other materials.

  • These licences are governed by their individual terms and are managed by the CEO or their delegate.

2. Copyright Ownership

2.1 Internally Created Materials

Copyright ownership for material created by staff, contractors, or on behalf of Pilates ITC is outlined in our Intellectual Property Regulations.

2.2 Third-Party Materials

Copyright in external materials remains with the original author, publisher, or rights holder unless otherwise agreed.

3. Moral Rights

Pilates ITC respects the moral rights of content creators, as outlined in the Copyright Act 1968, including:

  • Attribution – You have the right to be named as the author of your work.

  • Non-false attribution – Your work shouldn’t be falsely attributed or modified in a misleading way.

  • Integrity – Your work should not be used in a derogatory manner that harms your reputation.

Note: Moral rights apply only to individuals.

4. Safe Harbour Protection

From 29 December 2018, Pilates ITC is covered by Safe Harbour protections under Part V Division 2AA of the Copyright Act.

To comply:

  • We monitor for copyright infringement under our - Our Students - Code of Practice. Repeat offenders may lose access to IT systems after written warnings.

  • The Management Team and CEO act as our designated copyright contacts, responsible for liaising with rights holders.

  • We follow all prescribed notice and take-down procedures for disputed content.

Compliance

This policy aligns with the Standards for RTOs 2025, specifically:

  • Outcome Standard 5: Governance and Accountability – Ensures lawful and ethical management of learning and administrative resources.

  • Compliance Requirement 5.1.2 – RTOs must manage intellectual property and licensing in line with Australian law.

  • Compliance Requirement 5.2.1 – All information and resources provided to learners are used legally, fairly, and with proper authority.
